Justice is a concept elaborating a situation in which every one gets his due share in the society without any fear or favour and enjoy it freely without any unnecessary restriction. The only restriction on the free enjoyment of rights may be that it should not be injurious to the individual, social or national interests.

We Indians have inherited our legal system and most of our prominent laws from the British. As we can rightly imagine that since the British colonized India, to exploit it for their benefit, they enacted the legal rules here to maintain the order so that their exploitation is conveniently made possible. Britishers created the laws in India keeping into consideration their own economic and political interests and therefore they enacted the legal provisions in such a way that catered the interests of British and their local supporters.

Ambiguous provisions were made with wide powers in the hands of the police and executive authorities. Due to ambiguities in the laws their provisions were used by the British judges discriminatory against Indians, if they opposed the British rule or the authority of British officers or their Indian loyals.

After Independence we are still continuing with most of the laws of British time because they are serving the interest of the new rulers of India i.e. the politicians and bureaucrats. We know well that how our laws are enacted and enforced. We are still not able to enforce our large number of laws in their true spirit. Our politicians are the law makers and inspite of the constitutional guarantee of equality our laws apply to them differently. They are almost free from the application of laws unless they cross a certain limit. Similarly the bureaucrats who are considered the people’s servant are far more powerful than their masters(i.e. the people)and free from any legal control in amassing the public money and misusing their powers.

A common man in India is still suffering from the excesses of the government servants. Politicians who promise to work for the people get busy with their own business after being elected to their offices. The courts which are considered as the custodian of people’s rights are unable to provide common justice due to their inherent weaknesses. How many people think to go to courts for justice unless it is their last option?
